§ 1 Scope

  1. 1. These General Terms and Conditions (GTC) apply to legal relationships between the customer and our company. Consumers as well as entrepreneurs are considered customers within the meaning of the GTC.
  2. 2. The company only accepts deviating conditions of the customer if their validity has been expressly agreed.
  3. 3. To display the delivery areas, click on the links below and view the 'Delivery Areas' section. Deliveries outside of this area are made at our discretion.

§ 2 Conclusion of the Contract

  1. 1. The offers, information, and data on the http://127.0.0.1:3100/ page do not constitute an offer within the meaning of § 861 ABGB; they serve exclusively as an invitation to the customer to submit an offer ('invitatio ad offerendum').
  2. 2. However, the sub-point ' Go to checkout ' constitutes a final intention to enter into a contract in the sense of legal regulations. If the customer confirms their order by selecting the ' Click to order ' button as part of the order process, this is to be considered as acceptance, which establishes a work and delivery contract.

§ 3 Place of Performance

  1. 1. In the case of self-collection of the order, the place of performance for delivery and payment is the business premises located at Althan Straße. 2. If the food is delivered, the place of performance is the address provided by the customer in the order.

§ 5 Remuneration and Payment Conditions

In the case of self-collection or delivery

  1. 1. The offered prices are daily prices and are valid until revoked.
  2. 2. Prices are inclusive of statutory VAT.
  3. 3. The invoice amount must be paid by the customer immediately and without deduction in cash upon delivery or self-collection.

In the case of delivery

  1. 1. When ordering goods online with the option 'Delivery', a zone-based delivery fee is charged, which is included in the displayed total amount under ' Total amount ' (see also § 6 Delivery Conditions).

§ 6 Delivery Conditions

  1. 1. Delivery is carried out by us or by a commissioned agent for orders received during the delivery times defined in paragraph 2.
  2. 2. To display the addresses from which deliveries are sent, click on the links below and view the 'Address' section. These may differ from the working hours (see § 4).
  3. 3. It is possible to place pre-orders outside of official business hours. However, these orders will only be fulfilled within the delivery times defined in paragraph 2.
  4. 4. Home delivery is only available for orders above a certain total order value, which may vary depending on the zone, and a zone-dependent delivery fee will be charged (see also § 5). The total order value includes the delivery fee.
  5. 5. The exact spatial delimitation can be found in the scope under § 1 Para. 3.
  6. 6. Delivery is deemed to have been made upon handover of the goods to the customer. If the customer, for whatever reason, does not accept or cannot accept the handover, there are no claims by the customer against us. Although the customer is generally not obliged to accept, they must still pay the fee.

§ 7 Rejection of the Order

  1. 1. Rejection of the order is generally not envisaged but may become necessary due to exceptional circumstances (force majeure). If this is the case, the customer will be informed of the rejection of the order no later than 20 minutes after the occurrence.
  2. 2. Exceptional circumstances are those that significantly hinder contractual performance and are beyond our control due to their nature or cause.
  3. 3. In any case, substantial damage to buildings or inventory, circumstances endangering the lives or health of employees, as well as those rendering contract fulfillment impossible (power outage, burst pipe, etc.), fall under paragraph 2.

§ 8 Right of Withdrawal

  1. 1. Consumers do not have a right of withdrawal, as perishable food is processed and prepared specifically for the customer (see § 5f Para. 3 KSchG).

§ 9 Data Protection

  1. Customer data is managed in accordance with data protection regulations. Privacy policy

§ 10 Severability Clause

  1. Should individual provisions of this contract prove to be wholly or partially invalid or unenforceable, or become invalid or unenforceable as a result of changes in legislation after the contract is concluded, the remaining contract provisions shall remain unaffected.
